When you visit a California notary public to have a signature notarized, one of the most important things to bring is a valid form of identification. Under California law, a notary must certify the identity of the signer using “satisfactory evidence,” and the Secretary of State’s handbook explains that identity is established by acceptable identification documents or by credible witnesses when allowed.
For most people, the easiest and most common ID is a current California driver’s license or California ID card. California also accepts a U.S. passport, certain inmate identification cards, and other qualifying IDs that meet the statutory requirements. Some out-of-state IDs can also be accepted if they are current or issued within the last five years and include the required identifying information.
California law also allows a notary to rely on other forms of identification, including a state employee ID issued in California, an ID from a federally recognized tribal government, and certain out-of-state or Canadian or Mexican driver’s licenses or IDs, so long as the document meets the statutory requirements.
If a signer does not have a qualifying ID, California notary law may allow identification through credible witnesses in certain circumstances. The Secretary of State’s handbook explains that a signer’s identity may be established by the oath of a single credible witness, or by two credible witnesses, if the legal requirements are met.
This matters because a California notary’s job is to verify the signer’s identity and perform the notarial act correctly. For acknowledgments and jurats, the notary certifies the identity of the signer; the notary does not certify the truthfulness, accuracy, or legal validity of the underlying document. California’s statutory acknowledgment language says exactly that.
